Dayston Consultores, S.C. (hereinafter “Dayston”), located at Avenida Rubén Darío number 425, 7th floor, office 701, Circunvalación Vallarta, Zapopan, Jalisco, Mexico, postal code 44680, is responsible for protecting the personal data it collects from individuals (the “Data Subject”), regarding its collection, use, handling, disclosure, storage, and confidentiality (the “Processing”). In accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties ("LFPDPPP"), its Regulations, and applicable privacy notice guidelines, this Privacy Notice is issued under the following terms:

I. Personal Data Collected and Subject to Processing

We inform you that Dayston may collect your personal data, either directly or indirectly, when you provide your personal data to request professional services or job offers provided by Dayston through our website (the “Website”), by phone, through a third party, or any other personal or electronic means.

 

Dayston may process the following personal data obtained through the aforementioned means:

  • (i) Identification data;
  • (ii) Contact data;
  • (iii) Financial and credit information;
  • (iv) Employment data.

This data may be used, among other purposes outlined in Section II below, to assess and determine the services to be provided, analyze the quality of candidates for employment, verify the identity of legal entities, assess and rate creditworthiness, and for statistical purposes, as well as to comply with the Federal Law for the Prevention and Identification of Operations with Illicit Proceeds.

Dayston does not directly collect personal data from minors through forms, surveys, or via its website or any other medium. Furthermore, Dayston does not collect sensitive personal data for processing.

If you provide third-party data, whether for the acquisition of products or services offered by professional or commercial partners or for any other reason, it is your full responsibility to inform them about the transfer of their personal data to the Data Controller. In any case, Dayston will process such information in accordance with the provisions of the Law and this Privacy Notice. As the Data Controller and in compliance with the Law, we will provide such third parties with this Privacy Notice upon first contact.

Please note that Dayston does not work with agents, brokers, or similar figures. Therefore, any data you provide to a third party falsely representing Dayston will not be the responsibility of Dayston, and you, as the Data Subject, will be solely responsible for any information and personal data shared and its processing under such circumstances.

II. Purposes for Processing Personal Data

Dayston, and you, as the Data Subject, will be solely responsible for any information and personal data shared and its processing under such circumstances.

  • (a) Primary and Necessary Purposes for Service Provision

  • 1. Identifying the applicant and/or client, as applicable;
  • 2. Creating the client's information file;
    Management, control, administration, and processing of professional services provided;
  • 3. Investigation of changes in the client’s transactional profile;
  • 4. Compliance with tax or commercial obligations;
  • 5. Addressing client queries, concerns, clarifications, or complaints;
  • 6. Statistical and historical client records;
  • 7. Maintaining information and operational security; and
  • 8. Protection against identity theft.

  • (b) Informational, advertising, and/or professional prospecting purposes.

  • 1. Providing incentives or recognitions to clients, when applicable and offered by Dayston.
  • 2. Use of clients’ images and testimonials for advertising and professional directories related to services contracted and offered by Dayston.
  • 3. Improving customer service and relations.

Dayston may use cookies and/or web beacons to facilitate browsing on its website https://www.dayston.com.mx. Cookies are tools used by web servers to store and retrieve information saved in the browsers of users or visitors of the website, allowing the storage of personal preferences to provide a better browsing experience.

Cookies have expiration dates, ranging from the duration of the website visit to a specific date when they cease to function. Cookies used on https://www.dayston.com.mx are associated only with an anonymous visitor and their device, do not provide references that allow deducing the name and surname of the visitor, cannot read data from the hard drive, nor include viruses.

Dayston confirms that it does not collect personal data through these means; therefore, such data is not subject to Processing or transfers.

IV. Means for Exercising Data Subject Rights

In compliance with Chapters III and IV of the LFPDPPP, and to protect the personal data of our clients, we provide the following email address: info@dayston.com.mx, through which Data Subjects may limit the use or disclosure of their personal data, as well as deny or revoke authorization for its processing by exercising their rights of access, rectification, cancellation, and opposition (known as “ARCO Rights”) as provided by the applicable legal framework.

Your request must include an electronic copy of this signed Privacy Notice, indicating the sections for limiting the use or transfer of your personal data.As the Data Subject, you are responsible for keeping your personal data up to date with Dayston. Therefore, you guarantee and are liable, in any case, for the truthfulness, accuracy, validity, and authenticity of the personal data provided and agree to keep it properly updated by informing the Data Controller of any changes.

Written request addressed to our Legal and Compliance team, at Avenida Rubén Darío number 425, 7th floor, office 701, Circunvalación Vallarta, Zapopan, Jalisco, Mexico, postal code 44680, along with the format established above, a copy of your official ID, and, if applicable, a signed copy of this Privacy Notice indicating the designated sections to limit the use or transfer of your data.

Dayston will notify you within twenty business days from the date of receipt of the request regarding the decision made. If the request is granted, it will be executed within fifteen business days following the date on which the Data Controller communicates the response.

If the information provided in your request is incorrect or incomplete, or if the necessary documents to verify your identity or legal representation are missing, or any other required information, within five business days of receiving your request, we will ask for the missing information. You will have ten business days to respond, starting the day after you receive the request. If you do not respond within that period, your request will be considered not submitted.

If you are dissatisfied or feel your rights have not been upheld, you may contact the National Institute for Transparency, Access to Information, and Protection of Personal Data (INAI) to initiate a rights protection procedure.

VI. Transfer of Personal Data

As a general rule, Dayston will not transfer or share personal data, except when legally required or requested by a competent authority, or for the purpose stated in numeral 3, subsection (b) of Section II of this Privacy Notice. Additionally, we inform you that Dayston may grant access to third parties regarding the personal data it collects or receives for public or private audits to which Dayston is subject.

The third parties and entities receiving personal data in our custody assume the same obligations and/or responsibilities as Dayston, as outlined in this Privacy Notice, when receiving information from us.

VII. Revocation of Consent

At any time, you may revoke your consent for the processing of your personal data, provided that the revocation is legitimate and does not prevent compliance with obligations arising from an existing contractual relationship with Dayston or is not otherwise required by law or judicial mandate.

The refusal to process your personal data for these purposes and/or transfers will not affect your contractual relationship with Dayston.
